Welcome to HintEd (the “Platform”), operated by HintEd Company, Inc. (“HintEd,” “we,” “us,” or “our”).

By accessing or using our website (https://hinted.me), the HintEd browser extension, the HintEd Windows application, or any associated services (collectively, the “Services”), you agree to be bound by these Terms of Use (“Terms”). If you are using the Services on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

1. DESCRIPTION OF SERVICE

HintEd is a Digital Adoption Platform that provides a no-code toolset for creating interactive in-app walkthroughs, tooltips, popups, and software simulations. The Services are designed to assist in employee onboarding, customer support automation, and software training by layering guidance over existing web and desktop applications.

2. ACCOUNTS AND REGISTRATION

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your password and accept all risks of unauthorized access to your account.
• Promptly notify us if you discover or suspect any security breaches related to the Services.

3. LICENSE TO USE THE SERVICES

Subject to your compliance with these Terms, HintEd grants you a limited, non-exclusive, non-transferable, non-sublicensable license to:

• Install and use the HintEd Editor (extension or desktop app) to create guidance content (“Hints”).
• Deploy HintEd “flows” or walkthroughs on your internal or customer-facing applications.
• Access the HintEd Analytics Dashboard to monitor user adoption.

4. INTELLECTUAL PROPERTY RIGHTS

• HintEd IP: We own all rights, titles, and interests in the Services, including the software, no-code editor, branding, and proprietary algorithms.
• Customer Content: You retain ownership of the content you create using HintEd (e.g., the text and logic of your walkthroughs). By using the Services, you grant HintEd a worldwide, royalty-free license to host, store, and display this content solely for the purpose of providing the Services to you.
• Software Simulations: Content exported via our simulation feature (PDFs, LMS files) is your property, but is subject to the limitations of the underlying HintEd templates.

5. APPROPRIATE USE AND RESTRICTIONS

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of HintEd.
• Use the Services to create walkthroughs for malicious software or phishing.
• Interfere with the performance or integrity of the Services.
• Circumvent any usage limits or license tiers set forth in your subscription.

6. DATA PRIVACY AND SECURITY

Your use of the Services is also governed by our Privacy Policy, which explains how we collect and use your data.

• Enterprise Integration: If you use SSO, LDAP, or Active Directory integrations, you are responsible for maintaining the security of those credentials within your organization.
• Analytics: HintEd collects anonymized usage data (e.g., flow completion rates) to provide insights. We do not track sensitive end-user data unless specifically configured by you.

7. FEES AND PAYMENTS

• Subscriptions: Services are billed on a subscription basis (Monthly or Annually) as specified during the sign-up process.
• No Free Trial: Unless otherwise stated in a separate enterprise agreement, HintEd does not offer a free trial. All fees are non-refundable.
• Changes: We reserve the right to change our fees upon 30 days’ notice.

8. TERM AND TERMINATION

• Termination by You: You may stop using the Services at any time. Cancellation of a paid subscription will take effect at the end of the current billing cycle.
• Termination by HintEd: We may suspend or terminate your access if you breach these Terms or if your account remains unpaid. Upon termination, your right to display HintEd guides on your applications will cease.

9. DISCLAIMERS AND LIMITATION OF LIABILITY

• “As Is” Basis: The Services are provided “as is” without warranties of any kind. We do not guarantee that the Services will be error-free or that they will function perfectly on all third-party software.
• Limitation: To the maximum extent permitted by law, HintEd shall not be liable for any indirect, incidental, or consequential damages (including loss of data or profits) arising out of your use of the Platform. Our total liability shall not exceed the amount paid by you to HintEd in the 12 months preceding the claim.

10. INDEMNIFICATION

You agree to indemnify and hold HintEd harmless from any claims, damages, or legal fees resulting from your use of the Services, your violation of these Terms, or your infringement of any third-party rights (including privacy and IP rights).

11. GOVERNING LAW

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.

12. CHANGES TO TERMS

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the “Last Updated” date.
